entries in the name of the father of the petitioners, in Sy.No.26 measuring 2 acres in Thotagere Village, Nelamangala Taluk, Dasanapur Hobli, Bengaluru North Taluk. 2.
It is the contention of the petitioners that earlier when a writ petition was filed by father of the petitioners in W.P.No.5564/2002 complaining that his name was removed from the revenue records without notice, this Court disposed of the writ petition by order dated 05.06.2006 directing the Special Deputy Commissioner to redo the process after issuing proper notice to all concerned including the original grantee. However, till date the said directions have not been complied by the Special Deputy Commissioner. In the meanwhile, respondent No.5-respondent-Bangalore Metropolitan Transport Corporation Limited, who claims to have been granted with two pieces of property in Sy.No.26 totally measuring 13 acres 15 guntas is trying to put up a compound wall by encroaching upon the properties belonging to the

petitioners who have subsequently purchased the property under a registered sale deed dated 06.06.1985. 3. However, learned counsel Sri P. D. Surana appearing for respondent No.5-Corporation has today filed statement of objections along with a sketch at Annexure ‘R4’ which clearly demarcates the properties allotted in favour of the Corporation. Learned counsel submits that the Corporation is only putting up a fence or compound wall to protect the lands that are granted to the Corporation and the Corporation is not in any manner trying to encroach upon the properties belonging to the petitioners. Learned counsel submits that in terms of the sketch, the petitioners are not able to identify which is their property. Nevertheless, learned counsel submits that the Corporation will only put up fence to protect the lands that are granted to the petitioners. Further, it is submitted that in Block-1 measuring 9 acres and 17 guntas, the Corporation has undertaken the construction of the Depot in the said area. - 5 -

4.
At this juncture, learned counsel for the petitioners submits that the petitioners may be granted liberty to pursue their remedy before the second respondent-Special Deputy Commissioner in terms of the orders passed by this Court in the earlier petition. Learned counsel also prays that a direction may be issued to the second respondent to comply with the directions issued by this court in W.P.No.5564/2002. 5. Accordingly, the writ petition stands disposed of, reserving liberty to the petitioners to pursue their remedy before the second respondent-Special Deputy Commissioner, in the matter of entering the name of the petitioners’ father in the revenue records. The second respondent-Special Deputy Commissioner, Bengaluru Urban District, is also required to comply with the directions issued by this Court in W.P.No.5564/2002 dated 05.06.2006, by issuing proper notice to all concerned including the original grantee to consider the claim of the

petitioners to have their names entered in the revenue records and in the computerized RTC. 6. Having regard to the facts narrated hereinabove, notice may also have to be issued to respondent No.5- Corporation before considering the claim of the petitioners. All contentions of the parties are left open. Ordered accordingly. Sd/- (R DEVDAS) JUDGE
