The petitioner has filed this petition seeking following relief (s) : “10.1 That, this Hon'ble Court may kindly be pleased to call for entire records pertaining to the case of the petitioner. 10.2 That this Hon'ble Court may kindly be pleased to quash the impugned order dated -2- 29.09.2018 (ANNEXURE P/1). passed by respondent no. 2 and further be pleased to direct the respondent State to issue fresh circular regarding compassionate appointment towards death of Teacher (Panchayat), whereby providing compassionate appointment in all Class III, Class II post of the Gram Panchayat, Janpad Panchayat & Zila Panchayat, according to the qualification of claimant of deceased employee, in the interest of justice. 10.3 That, this Hon'ble Court may kindly be pleased to direct respondent authorities to give compassionate appointment to the petitioner, either in the post of Assistant Teacher (Panchayat) or in any other post according to her qualification, in the interest of justice. 10.4 That, any other relief/order which may deem fit and just in the facts and circumstances of the case, including cost of the petition may kindly be awarded to the petitioner” 2. Mr. Sharma, learned counsel appearing for the petitioner would submit that husband of the petitioner, who was a teacher under the respondent authorities died in harness on 23.04.2018. He would further submit that an application for grant of compassionate appointment was moved but same has been rejected vide order dated 29.09.2018 (Annexure P/1) on the ground that the petitioner does not have requisite qualification for the post of Teacher. Mr. Sharma would contend that according to the Policy for compassionate appointment, 2013, the petitioner may be offered an appointment against the Class-III or Class-IV post. She never claimed appointment to the post of Teacher and therefore, the observation made by respondent No.2/Director, Panchayat, Chhattisgarh Raipur is erroneous. 3 3. On the other hand, Mr. Bareth, learned Panel Lawyer appearing for the State would oppose submissions. He would submit that the petitioner lacks requisite qualification for the post of Teacher, therefore, her application has been rejected. 4. Heard the learned counsel appearing for the parties and perused the documents placed on record. 5. Taking into consideration the fact that husband of the petitioner was a Government Teacher and according to the Policy for compassionate appointment, 2013, she may be offered an appointment against the Class-III or Class-IV post and the petitioner never claimed appointment against the post of Teacher, therefore, the observation made in the order dated 29.09.2018 (Annexure P/1) is hereby quashed. The respondent authorities are directed to reconsider the claim of the petitioner for compassionate appointment strictly in accordance with the Policy for compassionate appointment, 2013. 6. The entire exercise shall be completed by the respondent authorities within a period of 120 days from the date of receipt of a copy of this order. 7.
