Nafde, learned counsel for the applicant, and Mr. K.A. Patil, learned counsel for the non-applicant. 2. As can be seen from the memo of the application, the marriage between the applicant and the non-applicant was solemnized on 13.12.2018. Due to some disputes, the non- applicant/husband filed a petition for dissolution of marriage before the Judge, Family Court at Nashik, bearing Petition No. A 218/2024. Thereafter, the respondent/wife, applicant herein, chose to file proceedings under the Domestic Violence Act before the Judicial Magistrate First Class, Narkhed, bearing Criminal Application No. 151/2024. Admittedly, both these proceedings are pending. 3. The present application seeking transfer of the proceedings pending before the Family Court, Nashik, to the Court of the Civil Judge, Senior Division, Katol. 4. Both the counsels have advanced their contentions with respect to their claims. However, Mr. K. A. Patil submits that the proceedings at Narkhed, filed by the wife, i.e., the applicant herein, be also transferred to Katol so that the non-applicant/husband can attend the proceedings at Katol. Shubham 2026:BHC-NAG:11076 (2) 19.MCA(Tr.)343.26 5. Mr. S. M. Nafde, in his usual fairness, has no objection to the said proceedings. 6. In that view of the matter, the following order is passed: ORDER i) The application is allowed. ii) Petition No. A 218/2024, pending before the Judge, Family Court, Nashik, is transferred to the Civil Judge, Senior Division, Katol. iii) In addition to that, the Domestic Violence Proceeding No. 151/2024, pending before the Judicial Magistrate First Class, Narkhed, is also transferred to the competent Court at Katol for trial in accordance with law.
