NARENDRA PRASAD ORAL ORDER This writ petition is filed under Articles 226 and 227 of the Constitution of India, calling in question the notification dated 04.10.2025 issued by respondent No.5, calling for applications to the post of Anganawadi Helper at the Anganawadi Centre, Hanumanahalli, vide Annexure-G. 2. The petitioner is working as an Anganawadi Helper at Devarahalli-3 Anganawadi Centre, Channagiri Taluk, Davanagere District. On 24.12.2023, the petitioner married one H.G. Kiran Kumar, who is a resident of Hanumanahalli. Therefore, the petitioner filed an application vide Annexure-H seeking transfer to the Anganawadi Centre, Hanumanahalli. During the pendency of the petitioner’s application, the impugned notification - 4 - HC-KAR NC: 2026:KHC:4368 WP No. 38398 of 2025 came to be issued. Hence, the petitioner is before this Court. 3. As per the Guidelines mentioned in the impugned notification issued by the Government dated 18.08.2018, whenever a vacancy arises in an Anganawadi Centre, first preference has to be given to applicants seeking transfer. Only if no such application for transfer is available, the Guidelines provide for issuance of a notification calling for applications to fill up the post. 4. In the present case, even though the petitioner had filed an application seeking transfer from Devarahalli- 3 Anganawadi Centre to Hanumanahalli Anganawadi Centre, without considering the same, the impugned notification has been issued. 5. In view of the Guidelines issued by the Government dated 18.08.2018, since preference has to be given to applicants seeking transfer from one Anganawadi Centre to another, the respondents are directed to keep in - 5 - HC-KAR NC: 2026:KHC:4368 WP No. 38398 of 2025 abeyance the impugned notification dated 04.10.2025 vide Annexure-G in respect of Item No.26, i.e., Hanumanahalli Anganawadi Centre, Yagati Grama Panchayat, till consideration of the petitioner’s application. The respondents are further directed to consider the petitioner’s application vide Annexure-H, in accordance with law, as expeditiously as possible, and in any event not later than four weeks from the date of receipt of a certified copy of this order. 6.
