THIS WRIT PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA PRAYING TO QUASHING THE IMPUGNED
ORDER DATED 07.11.2025 VIDE RRT.DISP/110/2025 PASSED BY THE 3RD RESPONDENT, PRODUCED AS ANNEXURE-F2 AND ETC.
THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE R DEVDAS
ORAL ORDER Learned Additional Government Advocate takes notice for respondents No.1 to 4. Notice to the 5th respondent is not necessary for the following reasons:
Learned Counsel for the petitioner submits that the 3rd respondent-Tahsildar, Gubbi Taluk, has issued the impugned endorsement at Annexure-F declining to enter the name of the petitioner in the revenue records, although a registered sale deed is executed by the 5th

respondent in favour of the petitioner, as found at Annexure-A.
2. It is the contention of the Tahsildar that since the land in question viz., 01 Gunta in Survey No.75/2 and another extent of land in 1.00 Acre and 31 Guntas and 8 Annas in Survey No.75/3 both situated at Ungra Village, C.S.Pura Hobli, Gubbi Taluk, were granted in favour of the 5th respondent herein, who belongs to SC/ST community, the purchaser could not have purchased the same without prior permission of the Government in terms of Section 4(2) of the Karnataka Scheduled Castes and Scheduled Tribes (Prohibition of Transfer of Certain Lands) Act, 1978 (for short, ‘PTCL Act’). Learned Counsel however submits that this Court in the case of Sri.A.B.Manjunatha and Others Vs. State of Karnataka and another in W.P.No.56721/2021, by order dated 05.08.2025 has held that the Tahsildar could not have declined to enter the name of the petitioners on the strength of a registered sale deed. It was also held that the only recourse

available for the Tahsildar was to initiate proceedings before the Assistant Commissioner. Unless and until the competent authority sets aside the sale as void, the Tahsildar cannot decline to enter the name of the purchaser in the land records. Learned Counsel seeks for similar orders. 3. Accordingly, the writ petition stands disposed of with a direction to the 3rd respondent-Tahsildar, Gubbi Taluk to issue notice to the 5th respondent and proceed to enter the name of the petitioner in the revenue records on the strength of the registered sale deed dated 17.10.2025 at Annexure-A, executed by the 5th respondent in favour of the petitioner. However, the Tahsildar is also required to take note of the observations made by this Court in such matters where the Tahsildar is of the opinion that the sale is contrary to the provisions of Section 4(2) of the PTCL Act, to initiate proceedings before the Assistant Commissioner in accordance with law. - 5 -
