P.P. …...... 07/20.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 80 & 3(5) of the Bharatiya Nyaya Sanhita. 2. Heard, learned counsel for the petitioner learned counsel for the State and have also gone through the impugned order. 3. Learned A.P.P. opposes the prayer for bail. 4. Petitioner is the husband. Death of the wife occurred within six months of marriage. There is demand of dowry and torture also and the death is unnatural. Thus, there is presumption against this petitioner as per law. 5. Considering the fact that there is demand of dowry and torture and the death is unnatural, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Nawadih P.S. Case No.49 of 2024, pending in the Court of learned A.C.J.M., Bermo at Tenughat stands rejected.
