THE HON’BLE SRI JUSTICE BATTU DEVANAND WRIT PETITION No.10009 of 2026 ORDER:- 1. This Writ Petition is filed seeking to declare the action of the respondents in trying to disposes the petitioner from petitioner’s land to an extent of Ac.0.03 cents in survey No.185/5A2, in Lakshmi Polavaram Village (Ravulapadu Village), Ravulapalem Mandal, Dr.B.R.Ambedkar Konaseema District, without acquiring the same as per law and also in violation of order, dated 09.12.2010 in W.P.No.964 of 2003, is illegal, arbitrary, violative of Principles of Natural Justice and consequently, prayed to direct the respondents not to interfere with the petitioner’s possession and enjoyment of the land stated supra. 2. Heard the learned counsel for the petitioner and learned Standing Counsel Mr.Anand Kumar appearing for the respondent Nos.1 & 7-N.H.A.I and learned Government Pleader for the Revenue Department. Perused the material available on record. 3. The grievance raised in this Writ Petition is that the respondents are trying to disposes the petitioner from the petitioner’s land to an extent of Ac.0.03 cents in Survey.No.185/5A2 situated at Lakshmi Polavaram Village (Ravulapadu Village), Ravulapalem Mandal, Dr.B.R.Ambedkar Konaseema District, without acquiring 2 the same, as contemplated under law and also the said act is in violation of the order, dated 09.12.2010 in W.P.No.964 of 2003. 4. During course of hearing of this case, Mr.Anand Kumar, learned Standing Counsel for the N.H.A.I., on oral instructions, would submit that they are not interfering into the land of the petitioner to an extent of Ac.0.03 cents in Survey.No.185/5A2 at Lakshmi Polavaram Village (Ravulapadu Village), Ravulapalem Mandal, Dr.B.R.Ambedkar Konaseema District. 5. Placing the submission of the learned Standing Counsel on record, the Writ Petition is disposed of, with the consent of both parties. It is made clear that in future, if the respondent- authorities intend to acquire the land of the petitioner for any public purpose, it is open to them to do so, by following due process of law. 6. No order as to costs.
