2026:JHHC:1496 IN THE HIGH COURT OF JHARKHAND AT RANCHI B. A. No. 9253 of 2025 ----- Pramod Paswan @ Pramod Kumar, S/o Late Vishu Paswan, R/o Village- Gowash, P.O. & P.S.-Kutumba, Dist.-Aurangabad, Bihar … …. Petitioner Versus The State of Jharkhand … …. Opp. Party ----- CORAM: HON'BLE MR. JUSTICE GAUTAM KUMAR CHOUDHARY ----- For the Petitioner : M/s Shekhar Pd. Sinha, Mahi & Satyam Kumar, Advocates For the State : Mrs. Shweta Singh, A.P.P. ----- Oral Order 02 / Dated : 20.01.2026 Heard learned counsel for the parties. The instant bail application has been filed by the present petitioner- Pramod Paswan @ Pramod Kumar, aged 26 years, who is in custody since 25.07.2023 in connection with Patan P.S. Case No. 92 of 2023 (S.T. No. 641 of 2023, G.R. No. 1482 of 2023) under Sections 376, 323, 504 and 506 of IPC, pending in the court of Additional Sessions Judge-V, Palamau. Earlier bail application of the petitioner was rejected by the Co- ordinate Bench of this Court in B.A. No. 2161 of 2024 and the present bail application is being renewed on the ground that the prosecutrix is habitual litigant and another case being Patan P.S. Case No. 105 of 2024 has been lodged against another accused under Section 64 and 351(2) of BNS, 2023. It is submitted by learned counsel for the petitioner that the prosecutrix has lodged altogether three cases of rape which includes one against her husband under Section 376 and 498A of IPC which finds mention in the order passed by learned court below. It is further contended that there is delay of more than two months in lodging the present FIR. The incidence is alleged to have taken place on 23.04.2023 whereas the FIR was lodged on 04.06.2023. Learned counsel for the State has opposed the prayer for bail. There appears to be no plausible explanation for the delay of two months in lodging the FIR. The prosecutrix is a major lady who had earlier 2026:JHHC:1496 2 filed a case under Sections 376 and 498A of IPC against her husband and one against her brother-in-law. There appears to be a pattern in filing of such cases which was not earlier brought to the notice of this Court. Under the circumstance, the bail application of the petitioner is allowed and the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
