Patgiri, the learned counsel appearing on behalf of the Petitioner and Mr. B. Gogoi, the learned counsel who appears on behalf of the PWD and the Finance Department of Assam. 2. The learned counsel appearing on behalf of the Petitioner submits that taking into account that there are issues which would require factual adjudication, the Petitioner would be well advised to approach the Competent Court of Civil Jurisdiction. He, therefore, submits that the Petitioner would like to withdraw the instant writ petition without prejudice to avail remedies before the Competent Court of Civil Jurisdiction. 3. Taking into account the above, the instant writ petition stands closed on withdrawal. 4. The withdrawal of the instant writ petition shall not prejudice the Petitioner to avail remedies before the Competent Court of Civil Jurisdiction, if so permissible under law.
