THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: - 3 - HC-KAR NC: 2026:KHC:3527 WP No. 37395 of 2025 CORAM: HON'BLE MR. JUSTICE ASHOK S.KINAGI ORAL ORDER The petitioner filed this writ petition challenging the endorsement dated 31.05.2025 vide Annexure-C and seeking a direction to consider the representation vide Annexure-B dated 31.05.2025 requesting permit the petitioner to appear for B.Sc Nursing examination. 2. Brief facts, leading rise to the filing of this writ petition are as follows: The petitioner joined B.Sc Nursing course (2016- 2020) batch in respondent No.1-College. Due to severe financial hardship, the petitioner was unable to appear for 2nd year and 4th year examination between 2020 and 2023. To regularise her academic progress within the permissible period, she submitted a representation on 31.05.2025 requesting permission to take pending examinations. Respondent No.1 without appreciating her - 4 - HC-KAR NC: 2026:KHC:3527 WP No. 37395 of 2025 genuine circumstances and without assigning any valid reasons, issued an endorsement dated 31.05.2025 rejecting her request, and thereby preventing her from appearing for the B.Sc. Nursing examinations. Such a refusal violates Articles 14 and 21 of the Constitution of India. Hence, the petitioner aggrieved by the impugned endorsement, filed this writ petition. 3. Heard the learned counsel for the petitioner, and also the learned counsel for respondent No.2. 4. Learned counsel for the petitioner submits that, due to financial difficulties, the petitioner was unable to appear for 2nd year and 4th year examinations between 2020 and 2023. He submits that she has submitted a representation to regularise her academic progress and respondent No.1 rejected the representation, and issued an impugned endorsement. He submits that the impugned endorsement is in violation of Articles 14 and 21 of the - 5 - HC-KAR NC: 2026:KHC:3527 WP No. 37395 of 2025 Constitution of India. Hence, on these grounds, he prays to allow the writ petition. 5. Per contra, learned counsel for respondent No.2 submits that the petitioner should have completed the course within four years. Further, if not completed, the petitioner should have completed the course within four years. She submits that the petitioner has not completed the course within eight years. Hence, the petitioner is not entitled for her academic progress in the Nursing course. Hence, on these grounds, she prays to dismiss the writ petition. 6. Perused the records, and considered the submissions of the learned counsel for the parties. 7. It is an undisputed fact that the petitioner got admitted in respondent No.1-College for B.Sc Nursing course for the academic year 2016-2020. As per the regulations of respondent No.2-University, the petitioner - 6 - HC-KAR NC: 2026:KHC:3527 WP No. 37395 of 2025 should have completed the B.Sc Nursing course within four years. If not completed, the petitioner should have completed the course within four years. Admittedly, the petitioner has not completed the course within eight years. Respondent No.1 considering the regulations of respondent No.2-University has rightly issued the impugned endorsement vide Annexure-C. This Court cannot direct the respondent-University to disobey its own regulations framed with an intention to have some discipline in the education. Respondent No.1 has rightly issued an endorsement. I do not find any grounds to entertain the writ petition. Accordingly, the writ petition is dismissed. 8. Pending application(s), if any, shall stand disposed off accordingly.
