HC-KAR NC: 2026:KHC:4152 CRL.P No. 16299 of 2025
CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA
ORAL ORDER
Heard Sri. Puttaraja C.P., learned counsel appearing for the petitioners and Sri. B.N. Jagadeesha, learned Additional Special Public Prosecutor appearing for respondent No.1.
2. The petitioners are accused Nos.7 to 12. They were accused in crime No.33/2022. Finding that there was no evidence against them while filing the charge sheet in C.C.No.3907/2022, these petitioners had been given up. Then the prosecution appears to have filed an application under Section 319 of the Cr.P.C. to draw them back into the web of proceedings. Notice is issued by the learned Magistrate by the following order:
"Accused No.2, 4 to 6 are present.
Accused No.1 and 3 are absent.
E.A filed.
Learned APP has filed I.A. under Section 319 of Cr.P.C. seeking to implead the proposed accused persons by name Pradeep, Abhi, Naveena, Tulsamma, Rajamma and Gundamma.
Hence, issue notice to proposed accused persons by name Pradeep, Abhi, Naveena, Tulsamma, Rajamma and Gundamma.

HC-KAR NC: 2026:KHC:4152 CRL.P No. 16299 of 2025
R/by 13.06.2025."
Issuance of notice is what has driven the petitioners to this Court in the subject petition.
3. The petition is undoubtedly premature. The petitioners would have all the remedy available in law after the names of these petitioners are drawn into the web of proceedings.
4. Reserving liberty to the petitioners to knock at the doors of the appropriate fora, finding the petition premature, the petition stands disposed.
