P.P. …...... 03/ 10.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as they are in custody for allegedly committing offence punishable under Sections 103(1)/3(5) of the Bharatiya Nyaya Sanhita. 2. Heard, learned counsel for the petitioners, learned counsel for the State and have also gone through the impugned order. 3. Learned A.P.P. opposes the prayer for bail. 4. Petitioners are not named in the FIR. Their name transpired from the confessional statement of the co-accused. It is alleged that these petitioners have given money to the co-accused to commit murder. Except this statement there is nothing in the case diary which suggests that the petitioners have committed the offense. Thus, this evidence is not enough to keep the petitioner in the custody. 5. Considering the aforesaid fact and the fact that petitioners are in custody since 18.06.2025 and the chargesheet has been filed, I am inclined to grant bail to these petitioners. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Seraikella in connection with Kuchai Police Station Case No.32 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioners, having sufficient landed property in his own name within the State of Jharkhand with a further condition that the petitioners shall appear and mark their attendance before the Registrar, Civil Court, Seraikella once in a month till the disposal of the trial.
