This is an application under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 filed by the petitioner namely, Amar Majumdar, praying for released on bail in connection with Chaygaon P.S. Case No. 59/2026 Page No.# 2/2 registered under Sections 21(b)/ 29 of the NDPS Act. 3. As per the allegation discernable from the FIR on the basis of the prior information, the petitioner was found on 20.03.2026 near the road side of NH- 17 at Bhatpara village and upon body search conducted on the petitioner in presence of the witnesses a quantity of 13 grams net weight of suspected heroin was recovered from him and accordingly, he was arrested. 4. The learned counsel for the petitioner submits that the petitioner has been falsely implicated and he has already spent 38 days behind the bar. 5. On the other hand, the learned Addl. Public Prosecutor has submitted that case diary including the statement of the independent witnesses as well as seizure list clearly indicate that the recovery was made from the person of the petitioner. 6. Having regard to the incriminating materials in the case diary despite the fact that the matter relates to intermediate quantity and considering the larger social interest, the prayer for bail stands rejected at this stage. 7.
