The case of the prosecution is that the petitioner has managing the shop, in which, the defacto complainant, aged about 22 years was working. Taking advantage of the proximity the petitioner had demanded sexual favour from her and also threatened her. Subsequently on the date of occurrence he abducted her in a Car to a lonely place and threatened her with dire consequences, touched her private parts, kissed her in appropriately. Hence, the complaint was lodged. 3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. With false accusations this complaint has been lodged. Even prior to the lodging of the present complaint, the petitioner has lodged a complaint against the defacto complainant regarding the threat made by her. He is in custody from 30.06.2026 and ready to abide any condition imposed by this Court. Hence, he prayed bail for the petitioner. 4. He opposed the grant of bail to the petitioner. 5. This Court heard both sides and perused the materials available on record. 6. I have gone through the statement of the victim girl recorded under Section 183(5) of BNSS, which shows various disturbing facts. However, it is not penetrative sexual assault and though the statement recorded from the victim reveals that it is a case of rape the accident register have not reveal any injuries on her body.
