Learned counsel for the petitioner, after arguing for some time, does not wish to press the present writ petition and submits that the learned trial Court may be directed to examine the defendant petitioner through a Commissioner in Court, and that the witness may be permitted to sit and give his evidence.
2. Having heard learned counsel for the petitioner, the writ petition is disposed of with the direction that the learned trial Court shall examine the defendant-petitioner through a Commissioner to be appointed by the Court in Court itself.
3. With the above observations, the present writ petition stands
disposed of.
4. Pending application(s), if any, shall stand disposed of.
