This bail application has been filed on behalf of Suraj Das @ Suraj Kumar Das and Shubham Kumar @ Kallu who are in custody since 28.07.2025 in connection with Bagbera P.S. Case No. 70 of 2025 for the offence registered under Sections 109 and 3(5) of the BNS, 2023 and Section 27 of the Arms Act (Sections 118(2), 103(1) of BNS, 2023 added vide order dated 17.07.2025) pending in the Court of learned Judicial Magistrate, 1st Class at Jamshedpur, is pressed into motion. Informant is the brother of the deceased and as per FIR, the deceased was picked up from his shop at night around 10:30 pm and was shot dead. FIR was lodged against five named accused persons including this petitioner. It is submitted by the learned counsel on behalf of petitioner that as per the restatement of the informant recorded during investigation, it was Rahul Yadav who had fired at the deceased. It is also submitted that similarly situated co-accused namely, Ranjan Kumar @ Ranjan Kumar Singh has already been enlarged on bail by Co-ordinate Bench of this Court in B.A. No. 11157 of 2025. It is further submitted that the allegation is mainly on Rahul Yadav and this petition is roped into the case only on suspicion. Learned A.P.P. for the State assisted by counsel on behalf of the informant opposed the prayer for bail and submitted that informant was also present at the place of occurrence. 2026:JHHC:5095 Direct allegation of firing is against another co-accused. Under the circumstances, the above-named petitioners are directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) each with two sureties of the like amount each to the satisfaction of the Court below.
