Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, order or direction mostly one which is in the nature of a Writ of Mandamus declaring the action of the Respondents in non-payment of amount of Rs. 17,77,267/- due to the Petitioner even after finalizing the bills, payable in relation to the work executed i.e. Providing BT to the Road from Nuzvid to meet RB Road at Yenamadala via Regunta in Nuzvid (M) as illegal, arbitrary, unjust, unfair, unreasonable and unconstitutional and consequently direct the Respondents to make the payment of full amounts due to the Petitioner without any deductions / recoveries in respect of execution of work carried out by the Petitioner and with reasonable interest for delayed period forthwith and pass

O R D E R This Writ Petition is filed seeking the following relief:
“….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in non-payment of amount of Rs.17,77,267/- due to the petitioner even after finalizing the bills, payable in relation to the work executed i.e. “providing BT to the road from Nuzvid to meet R&B Road at Yenamadala via regunta in Nuzvid (M)”, as illegal, arbitrary, unjust, unfair, unreasonable and unconstitutional and consequently, direct the respondents to make the payment of full amounts due to the petitioner without any deductions/recoveries in respect of execution of work carried out by the petitioner and with reasonable interest for delayed period forthwith and pass such other order or orders …”

Heard learned counsel for the Writ Petitioner, learned Assistant Government Pleader for Panchayat Raj and Rural Development representing respondent Nos.1, 3 to 7, and learned Assistant Government Pleader for Finance, representing respondent No.2. 3. The Government of Andhra Pradesh awarded a contract work of providing BT to the Road from Nuzvid to meet R&B Road at Yenamadala via Regunta in Nuzvid (M) to the Writ Petitioner Company. The estimated contract value was Rs.1,86,00,000/-. The Writ Petitioner company entered into an Agreement with 4th respondent on
15.09.2018. The Writ Petitioner executed the entire work as per the Agreement, and the respondent authorities examined and scrutinized

the same, and made entries in the M-Book. The Writ Petitioner company was paid a part net payment of Rs.38,71,971/- and kept pending the bill for an amount of Rs.17,77,267/-. As per the Measurement Books and Pass Orders issued by the respondents vide 2023-1566260, the said sum was not paid to the Writ Petitioner Company. Though the Writ Petitioner Company approached the respondent authorities on multiple occasions, requesting for payment of pending bill amount of Rs.17,77,267/-, they are not doing so. According to Writ Petitioner, having executed the work satisfactorily, within the prescribed time, non-payment of the bill amount was arbitrary and unjustified.
It was further contended that the delay in payment is causing severe financial hardship, necessitating the filing of the present Writ Petition seeking appropriate directions for release of the outstanding amount. 4. Learned Assistant Government Pleader for Panchayat Raj and Rural Development, on written instructions received from the Executive Engineer, PR Division, Nuzvid-5th respondent, submits that the total value of contract work done was Rs.61,32,979/-, out of which, a sum of Rs.7,08,279/- towards QC Recovery is to be deducted, which comes to Rs.54,24,700/-, of which, an amount of Rs.43,55,712/- was already paid to the Writ Petitioner Company. She further submits that

the Writ Petitioner Company is entitled to an amount of Rs.10,68,988/-, which is the admitted amount to be payable to the Writ Petitioner company and while submitting the bill in NIDHI Portal, an error occurred showing Insufficient Budget for the DDO and HOA and prays time for Six (06) weeks. The written instructions are placed on record. 5. There is no dispute with regard to the works executed by the Writ Petitioner. But with regard to the amount claimed, the Writ Petitioner Company claims a sum of Rs.17,77,267/-, whereas, according to learned Assistant Government Pleader, as per the written instructions of 5th respondent, the Writ Petitioner Company is entitled to a sum of Rs.10,68,988/-. In view of the submission made by the learned Assistant Government Pleader for Panchayat Raj and Rural Development, the respondent authorities are directed to pay the admitted amount of Rs.10,68,988/- (Rupees Ten Lakhs Sixty Eight Thousand Nine Hundred and Eighty Eight only) to the Writ Petitioner Company within a period of Six (6) weeks from the date of receipt of a copy of this order. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs of the Writ Petition. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition, shall stand closed.
