UDD 291 BBS 2025), PRODUCED AT ANNEXURE B, ISSUED BY THE RESPONDENT NO. 1, THEREBY DRASTICALLY ALTERED THE BOUNDARIES OF WARD NO. 38 IN A DISCRIMINATORY MANNER, ALLOTTING ONLY 19,639 VOTERS TO THE SAID WARD, AND RESTORE THE PREVIOUS NOTIFICATION DATED 30/09/2025 WITH 25000 VOTES, PRODUCED AT ANNEXURE D AND ETC. THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. Learned counsel for the petitioner submit that he does not wish to press prayer-A. Hence, prayer-A is deleted from the petition. Learned counsel for the - 3 - HC-KAR NC: 2026:KHC:6971 WP No. 37300 of 2025 petitioner is directed to carry out necessary endorsement to that effect. 2. The petitioner is before this Court seeking for the following reliefs; a. Issue a writ of certiorari or any other appropriate writ, quashing delimitation the impugned notification dated 19.11.2025 (Notification No. UDD 291 BBS 2025), produced at Annexure B, issued by the Respondent No. 1, thereby drastically altered the boundaries of Ward No. 38 in a discriminatory manner, allotting only 19,639 voters to the said ward, and restore the previous notification dated 30/09/2025 with 25000 votes, produced at Annexure D b. Issue a writ of mandamus directing the Respondent No 1 to act as per the previous delimitation order dated 30/09/2025 in No UDD 291 BBS 2025 produced at Annexure D. c. Issue a writ of mandamus or any appropriate writ directing the Respondents No 1 and 2 to review the allotment of the voters from 19,000 to 25,000 as allotted to the neighbouring wards by considering the representations dated 26/11/2025 produced at Annexure-F and representation dated 01/12/2025, produced at Annexure "G" d. And to pass appropriate orders under the facts and circumstances of the case, in the interest of justice and equity 3. The grievance of the petitioner is that insofar as Ward No.38, Nandini layout is concerned the number of voters as per the list are stated to be 19,639 and - 4 - HC-KAR NC: 2026:KHC:6971 WP No. 37300 of 2025 in respect of the other wards the number of voters are in excess of 25,000 and in that background he submits that the representation which has been submitted by the petitioner to increase the number of voters in Nandini Layout Ward be considered by the respondents. It is in that background, the representation dated 01.12.2025 had been submitted by the petitioner for increasing the number of voters in the ward. 4. I am unable to agree with the learned counsel for the petitioner to issue a mandamus for such a direction of consideration of the representation. When there are 19,000 voters in the said ward, only four of them are before this Court and even as regards that aspect, it is in dispute as to whether three of them are residing within Nandini layout or outside in other wards. 5. Be that as it may, such representation by few persons to the State to increase or decrease the - 5 - HC-KAR NC: 2026:KHC:6971 WP No. 37300 of 2025 number of voters cannot be directed to be considered, since there is no vested right in the petitioners and it is not clear from the petition or from the submission as to how they are affected by reduced number of voters. Hence no grounds being made on the petition stands dismissed. SD/- (SURAJ GOVINDARAJ) JUDGE SR List No.: 2 Sl No.: 22
