THIS PETITION COMING ON FOR ORDERS THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER 1. This petition is filed by the sole accused under Section 483 of BNSS praying to grant bail in Crime No. 388/2025 of Chintamani Rural Police Station registered for offence under Sections 108 and 352 of BNS. 2. Heard learned counsel for petitioner and learned HCGP for respondent – State. 3. Learned counsel for petitioner would contend that petitioner is single parent and she had relationship with the deceased. The deceased insisted the petitioner to go together to Bengaluru and lead life. Petitioner refused and stated to have asked the deceased to commit suicide and gave him a saree for the same. Thereafter the deceased has committed suicide. Said act of the petitioner asking the deceased to go and die does not amount to - 3 - HC-KAR NC: 2026:KHC:5769 CRL.P No. 16697 of 2025 abetment. Now chargesheet has been filed and therefore petitioner is not required for further custodial interrogation. The offence alleged against the petitioner is not punishable either with death or imprisonment for life. With this, he prayed to allow the petition. 4. Per contra learned HCGP would contend that the petitioner and deceased were in relationship. Petitioner told the deceased to go and die and gave him a saree for hanging himself. Said act of petitioner amounts to abetment to commit suicide. Chargesheet material show prima facie case against the petitioner for offence alleged against her. With this he prayed to reject the petition. 5. Having heard learned counsel for the parties, the Court has perused chargesheet and other materials placed on record. 6. Case of the prosecution as per chargesheet is that the petitioner was in relationship with the deceased. The deceased insisted the petitioner to come along with - 4 - HC-KAR NC: 2026:KHC:5769 CRL.P No. 16697 of 2025 him to Bengaluru as it had become difficult for him to stay in the village. Petitioner refused to go along with him to Bengaluru and told him that there is no necessity of him hereinafter and asked him to go and die and gave him a saree. Deceased committed suicide by hanging with the saree to a tree. The accusation against the petitioner is that she gave saree to the petitioner to commit suicide and asked him to go and die. Whether the said act of the petitioner asking the deceased to go and die and giving him a saree amounts to abetment to commit suicide is a matter of trial. Petitioner is in judicial custody since 13.11.2025 and as chargesheet is filed, she is not required for further custodial interrogation. The offence alleged against the petitioner is not punishable either with death or imprisonment for life. 7. Considering the above aspects, petitioner has made out a case for grant of bail with conditions. In the result, the following; - 5 - HC-KAR NC: 2026:KHC:5769 CRL.P No. 16697 of 2025 O R D E R Petition is allowed.
