For Petitioner(s): Mr.J.Ramakrishnan For Respondent(s): Mr.R.Rajasekaran Government Advocate (Criminal Side) https://www.mhc.tn.gov.in/judis CRL OP No. 18596 of 2026 __________ Page2 of 5 ORDER This Criminal Original Petition has been filed to direct the Sessions Judge, Special Court for the Trial of cases under SC/ST (POA) Act, Tiruppur to consider the bail application of the petitioner in Spl.SC.No.29 of 2025 in Crime No.261 of 2018 on the file of the Inspector of Police, Udumalpet Police Station, on his surrender on the same day. 2. The petitioner is an accused in Spl.S.C.No.29 of 2025 on the file of the learned Special Court for Trial of the SC/ST (Prevention of Atrocities) Case, Tiruppur. It is stated that the Trial in respect of the co-accused is already over, and the split-up case against the petitioner is pending. An NBW was issued against the petitioner, and the petitioner is said to be a long absentee. Under these circumstances, the petitioner has come up with the present petition. 3. In view of the facts and circumstances of the case, I am of the view that the prayer of the petitioner to take up the warrant re-call application shall be considered on the same day, provided the petitioner surrenders before the Trial Court. 4. Under these circumstances, this Criminal Original Petition is ordered on the following terms: https://www.mhc.tn.gov.in/judis CRL OP No. 18596 of 2026 __________ Page3 of 5 (i) The petitioner shall serve an advance notice of the surrender petition and the re-call of the NBW petition on the prosecution as well as the defacto complainant intimating the proposed date of surrender. (ii)The respondent police shall also independently inform the defacto complainant about the surrender and the hearing of the recall of the NBW application, including the date and the Court.
