Mr ___________________________________________________ Sandeep Sharma, Judge(oral): Petitioner herein, who at present is working as JBT at Government Primary School, Daran, Education Block, Banjar, District Kullu, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his representation dated 07.08.2025 (Annexure P-1), whereby he has prayed for his transfer from afore station to one of the stations as detailed in the representation on the ground of disability. 2. Petitioner herein, who is 40% disabled and has completed his normal tenure of posting at present place of posting, has filed representation to the competent authority, praying therein for his transfer from present place of posting to other station on the ground of disability. Since petitioner on account of his disability is finding it difficult to work at present place of posting, he has prayed for his transfer, as detailed hereinabove. 1Whether the reporters of the local papers may be allowed to see the judgment? 2 3. Having regard to the nature of prayer and order proposed to be passed, this Court sees no necessity to call for reply on behalf of the respondents, who are otherwise represented by Mr. Rajan Kahol, learned Additional Advocate General. Learned Additional Advocate General fairly states that representation, if not already decided, shall be decided expeditiously. 4. Since it is apparent from the pleadings as well as documents adduced on record that petitioner has completed normal tenure of posting at present place of posting, coupled with the fact that he is 40% disabled, this Court without going into the merits of the case, deems it fit to dispose of the present petition, with a direction to the respondents to consider and decide the pending representation dated 07.08.2025 (Annexure P-1) of the petitioner expeditiously, preferably within a period of four weeks. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass appropriate order, taking note of transfer policy formulated by the Government of Himachal Pradesh, which enables an employee having disability to seek transfer/ adjustment at a convenient station.
