The Petitioner is before this Court seeking for the following reliefs; a. Issue writ in the nature of certiorari or any other writ or order to quash the impugned order dated 24.02.2024, passed by the R4 in Chow/Gra/Pan/209/2024-25 which is produced at Annexure-C and issue direction to R4 to restore the name of petitioner in the records of Gram Panchayath in respect of property bearing No.363 in Sy.No.95 measuring East to West 65 feet and North to South 68 feet, situated at Dinne Hosahalli Village, Narasapura Hobli, Kolar Taluk. b. The grievance of the petitioner is that the impugned order dated 24.02.2025 passed by respondent No.4, is without any notice having been issued to the petitioner. 3. Learned counsel for respondent No.4 was called upon to obtain instruction and make his submission as to whether any notice has been issued. If notice had been issued to place the acknowledgement of service thereof on the learned counsel for the petitioner. 4. Today, Smt. Vathsala, PDO of respondent No.4, is present before this Court in person, and on her instructions, Sri M.S.Devaraju, learned counsel submits that there is no notice which had been issued to the petitioner. 5. If that be so, the impugned order dated 24.02.2025 would not be sustainable, as such, I pass the following: ORDER i) Writ petition is allowed. - 4 - HC-KAR NC: 2026:KHC:4398 WP No. 37673 of 2025 ii) A certiorari is issued, the impugned order dated 24.02.2025 passed by respondent NO.4 as Annexure – C, is quashed. iii) Liberty is, however, reserved to respondent No.4 to issue a fresh and proper notice to the petitioner to consider the reply submitted by the petitioner and pass necessary orders in accordance with law. iv) The name of the petitioner is directed to be restored in the revenue records within a period of 30 days from the date of receipt of a copy of this order.
