Gratuity and leave Salary with 10 percent interest to the petitioner.” 2. The petitioner joined the respondent corporation on 21.07.1998 and dismissed from service on 17.09.2012. The respondent management sought approval for the dismissal through A.P. No. 252 of 2012 before the Special Deputy Commissioner of Labour, however, the approval petition was dismissed vide order dated 05.08.2014. The management challenged the said order in W.P. No. 33501 of 2015 and the same was rejected by the this Court and the review application filed in Review Application No.74 of 2019 was also dismissed by order dated 15.03.2019. Consequently, the petitioner was directed to rejoin duty on 02.03.2020. 3. The petitioner would submit that since back wages for the period of non-employment were not paid, he filed filed C.P. No. 161 of 2019 before the learned II Additional Labour Court, Chennai. The labour Court by order 11.04.2023, directed the management to pay a sum of Rs.11,70,002/- in five instalments, with 9% interest in case of default. The https://www.mhc.tn.gov.in/judis WP No. 26080 of 2026 __________ Page3 of 8 management challenged this order in W.P.No.133 of 2024, which was dismissed by this Court on 26.06.2025, directing compliance of the labour court's order. 4. The petitioner would further submit that he retired from service on 30.04.2025. Though the management has filed writ appeal in W.A. Sr. No. 53429 of 2026, the same remains pending. The grievance of the petitioner is that despite reinstatement and retirement, the respondent failed to fix correct wages, pay full pension and retirement benefits, and provide the free bus pass available to retired employees. The petitioner submitted representation in this regard. However, no action was taken on the side of the respondents. Therefore, the petitioner is before this Court for the aforesaid relief. 5. Heard the learned counsels on the either side and perused the records. 6. A perusal of the records would show that the petitioner who was working as a conductor in the respondent corporation had been dismissed from service by proceedings dated 17.09.2012. The respondent thereafter https://www.mhc.tn.gov.in/judis WP No. 26080 of 2026 __________ Page4 of 8 filed approval petition before the Special Deputy Commissioner of Labour in AP.No.252 of 2012. The said petition was rejected by order dated 05.08.2014. The rejection order was challenged before this Court in WP.No.33501 of 2015. By order dated 03.02.2016, the punishment was set aside and the matter was remitted back to the respondent corporation to impose minor punishment. 7. The respondent management filed a review application Rev.Appl.No.74 of 2019, which was dismissed on 15.03.2019. Thereafter, it is seen that the petitioner was reinstated in service on 02.03.2020 by orders of the respondent dated 29.11.2019. Thereafter, the petitioner filed CP.No.161 of 2019 on the file of the II Additional Labour Court seeking back wages for the non employed period which was also granted by the labour court directing the respondents to pay it on or before 31.08.2023, failing which the same would attract interest at 9%. 8. This was challenged unsuccessfully by the respondent management in WP.No.133 of 2024. While dismissing the writ petition, it is seen that this Court directed the respondent management to follow the order passed by the II Additional Labour Court, Chennai, in CP.No.161 of https://www.mhc.tn.gov.in/judis WP No. 26080 of 2026 __________ Page5 of 8 2019. An appeal had been filed challenging the order passed in WP.No.133 of 2024, which is pending consideration. The petitioner who has retired in the interregnum has not been paid his retiral benefits. 9. That apart, the respondents have not fixed the petitioner’s wage correctly on par with his coworker. The petitioner’s co-worker were fixed basic wage of Rs.47,500/-, whereas, the petitioner is being paid only a sum of Rs.27,200/-. There is absolutely no reason as to why the petitioner is being paid half the amount. The petitioner has been reinstated in service and is entitled to continuity of service and all the attendant benefits which also includes payment of the correct wages. The order of the labour court in CP.No.161 of 2019 has been confirmed and the respondent has not obtained any order setting aside the same. 10. Therefore, the respondents have to necessarily take steps to fix the petitioner’s correct wages by taking note of the orders of this Court as well as the labour Court and bring it on par with his co-worker. The said exercise shall be done within a period of 8 weeks, from the date of receipt of a copy of this order. https://www.mhc.tn.gov.in/judis WP No. 26080 of 2026 __________ Page6 of 8 11. With the above observation and direction, this writ petition is allowed.
