2. Mr. Deepak Bisht, learned DAG, for the State of Uttarakhand.

In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Abrar, who has been accused in FIR No.12 of 2026, under Section 305 of the Bharatiya Nyaya Sanhita, 2023, at Police Station Pulbhatta, District Udham Singh Nagar.

Learned counsel for the Applicant submits that the Applicant has falsely been implicated in the present matter. He further submits that there is a delay in lodging of the FIR. He further submits that the Applicant is languishing in jail since 01.02.2026 and has no criminal history. It is further contended by the learned counsel for the Applicant that the Applicant is not named in the FIR and no test identification parade was conducted.

Learned counsel for the Applicant further submits that the co-accused, namely, Abrar, has been granted bail by this Court in BA 1st No.486 of 2026, vide judgment and order dated 29.04.2026.
6. Bail application has been opposed on behalf of the learned State Counsel on the ground that the Applicant is
having a criminal history and the Applicant is a resident of Uttar Pradesh and prays that the bail may not be granted to the Applicant.
7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail.
8. Accordingly, bail application is allowed. It is directed that the Applicant - Abrar, who has been accused in FIR No.12 of 2026, under Section 305 of the Bharatiya Nyaya Sanhita, 2023, at Police Station Pulbhatta, District Udham Singh Nagar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him.
