CRL OP No. 18540 of 2026 __________ Page2 of 4 Order This Criminal Original Petition seeks to quash Spl.SC.No. 117 of 2025 on the file of the Principal District and Sessions Court, Kancheepuram, for alleged offences under Sections 376(1), 363, 366, 376(2)(n), 506(2), 376(2)(h), 450 of IPC Sections 4(1), 6(1) of the Protection of Children from Sexual Offences Act, 2012, (the POCSO Act) on the ground of compromise between the parties. The de facto complainant is present before the Court and press that the case can be quashed on compromise. The parties, on examination, would stand by their compromise. 2. This is a case under POCSO Act and this Court will not go on the version of the prosecutrix alone. However, it can be seen that in this case, originally the police suspected the child to have gone away. The police suspected the petitioner as the offender and his name was included. However, it is now submitted before this Court that the de facto complainant and A2 / petitioner in Crl.O.P.No.18544 of 2026 are only having a relationship and subsequently they have also married and, on their representation, this case can also be quashed. 3. It is also brought to the notice that when the child was born, DNA test was also done which pointed out only towards A2 / Veeraragavan alias Veera.
Under the said circumstances, firstly, no offence at all is made out as against https://www.mhc.tn.gov.in/judis
CRL OP No. 18540 of 2026 __________ Page3 of 4 this petitioner and secondly, in view of the fact that the de facto complainant and the A2, who is said to be the person responsible for the sexual assault on the victim child have subsequently living as husband and wife and that the child is also born to them and, in view of the compromise between the parties, this case can be quashed as against this petitioner also. 4. For all the above reasons, the Crl.O.P.No.18540 of 2026 is allowed. The final report and all further proceedings in Spl.S.C.No.117 of 2025 stands quashed. Consequently, connected miscellaneous petition is closed. 15-07-2026 Neutral Citation: No KKN To
