ORDER (Order of the Court was made by Dr.G.Jayachandran J.) The tenants in an unauthorised building are the writ petitioners herein. After following due process of law, the authorities had finally issued a notice to the petitioners for removal of the unauthorised construction. The landlord filed W.P.No.18323 of 2026, challenging the order passed by the Municipality, pursuant to the dismissal of the revision by the Government. The said writ petition was dismissed by this Court on 29.06.2026. While so, this Writ Petition is filed by the tenants, seeking 25 months’ time to vacate the premises, since they are carrying on a commercial activity in the said building. Since the building itself is an unauthorised structure, the authorities have proceed to remove the same. There cannot be a better right to the tenants than what the landlord possesses.
2. We have already dismissed the writ petition filed by the landlord. The
order of demolition has not come overnight. Pursuant to the order passed by this Court in W.P.No.9523 of 2024, action has been taken for removal of the unauthorised construction. Hence, we are unable to entertain the prayer of the petitioners herein. However, on note of sympathy, we request the official https://www.mhc.tn.gov.in/judis
WP No. 27131 of 2026 __________ Page3 of 4 respondents to afford 30 days’ time for the petitioners to remove their belongings from the building. On expiry of 30 days from today, the authorities shall proceed to remove the unauthorised construction as per law.
3. Writ Petition is disposed of accordingly. No costs. Consequently, the connected W.M.P.No.29693 of 2026 is closed.
