1. Heard on application (IA No.990/2025) for condonation of delay in filing the appeal.
2. For the reasons mentioned in the application, the same is allowed. Delay in filing the appeal is condoned.
3. Mr. Vigyan Shah, AAG submits that the present appeal assails the common judgment dated 07.04.2025 passed by the learned Single Judge. He points out that the learned Single Judge has decided a bunch of petitions relying on the judgment passed in the case of Hakimuddin Versus State of Rajasthan & Ors.,
[2026:RJ-JP:13123-DB] (2 of 2) [SAW-1262/2025] (S.B. Civil Writ Petition No.14393/2024, decided on 12.12.2024.). It is pointed out that the State has challenged the said order of the Single Bench dated 07.04.2025 by way of filing D.B. Special Appeal (Writ) No.1126/2025, State of Rajasthan & Ors. Versus Pooja Agarwal and the said appeal came to be dismissed by the Co-ordinate Bench of this Court at Jaipur vide order dated 08.12.2025 in the light of the Judgment dated 18.09.2025 passed by the Co-ordinate Bench of this Court at Principal Seat at Jodhpur in the case of State of Rajasthan & Ors. Versus Deepesh Mudgal and Another.
4. Keeping in view the above, we need not further deal with the present appeal and the same is, accordingly, dismissed in the similar terms as in the case of State versus Pooja Agarwal (supra).
