Petitioner has filed this writ petition seeking following reliefs. “10.1 That, this Hon’ble Court may kindly be pleased to quash the order 13.02.2026 (Annexure P-2) whereby no chance given to the petitioner for any reply and no motive has given by the department. 10.2 That, this Hon’ble Court may kindly be pleased to permit to make a representation before the respondent authority. Learned counsel for petitioner submits that against the order Annexure P-2 dated 13.02.2026, petitioner has preferred a representation which is pending consideration and therefore, petitioner may be permitted to submit a fresh representation before Respondent No. 2 and direction be issued to the concerned authority to take decision on the representation to be submitted by petitioner at the earliest within specified time frame. 3. Learned State counsel submits that order Annexure P-2 with which petitioner is aggrieved is an order of imposing penalty and therefore petitioner is having remedy of filing appeal under Rule 23 of the Chhattisgarh Civil Services (Classification Control and Appeal) Rules, 1966. 4. Learned counsel for petitioner submits that in view of the submission made by learned State counsel, he may be permitted to withdraw this writ petition with liberty to file appeal before the appellate authority as provided under the Rules, 1966. 5. In view of above submission made by learned counsel for the respective parties, this writ petition is disposed of permitting the petitioner to submit appeal before the appellate authority as provided under the law and if such an appeal is submitted, the concerned appellate authority shall consider and decide the same in accordance with law, expeditiously thereafter. 6.
