Zaid Ahmed, Advocate For the State : Mr. Achinto Sen, A.P.P. 02/20.02.2026 The petitioner is an accused for the offences punishable under Sections 310(2) and 311 of the Bharatiya Nyaya Sanhita, 2023. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged. Initially, the F.I.R. was lodged against 12 unknown persons who allegedly committed ‘dacoity’ at “Purohit Niwas, Simdega” and looted Rs.3,50,000/- as well as a mobile phone from there. In course of investigation, the name of the petitioner surfaced on the alleged confessional statement of co- accused Mukesh Kiro. Though there is alleged recovery of Rs.3,900/- from the possession of the petitioner, however the same belongs to him. It has also been alleged that on the date of incident, the tower location of the petitioner’s mobile phone was found near the place of occurrence, however the same itself is not sufficient to connect him with the alleged offence. The petitioner has no criminal antecedent as has been stated in paragraph-19 of the present bail application. He is in judicial custody in connection with the present case since 16.10.2025 and hence, he may be given the privilege of regular bail. 2026:JHHC:5167 - 2 - 3. Learned A.P.P. opposes the petitioner’s prayer for regular bail. 4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on bail. 5. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Simdega in connection with Muffasil P.S.
