The petitioners are apprehending their arrest in connection with Telaiya P.S. Case No. 323 of 2025, registered for the offence under Sections 115(2), 117(2), 118(1), 109(1), 126(2), 127(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Additional Chief Judicial Magistrate, Koderma. 3. Learned counsel appearing for the petitioners submits that the altercation took place due to drainage of dirty water between the parties and both the sides are neighbours and co-sharers of the ancestral property. He submits that there are general and omnibus allegations and also there are case and counter case between the parties and both the sides have received injuries. He next submits that the [2026:JHHC:5002] -2- petitioners are having no criminal antecedent and disclosure to that effect has been made in para-14 of the petition. 4. Learned A.P.P appearing for the State has opposed the prayer and submits that the allegation of assault is there and pursuant to that the injury has also been received. 5. Considering that there are case and counter case between the parties and both the sides have received injuries and the altercation took place due to drainage of dirty water and further both the parties are agnates, in that view of the matter, the petitioners, named above, are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
