(2) Petitioners were engaged as Seasonal Collection Peon in District Haridwar. Their engagement, however, was discontinued in the year 2006. Petitioners filed Writ Petition (S/S) No. 1588 of 2023, which was disposed of with liberty to them to make representation to the competent authority for their reengagement and the District Magistrate was asked to take decision on petitioners’ representation. Representation made by petitioners was rejected by holding that now there is no post of Collection Peon available in District Haridwar.

Learned Counsel for the petitioners has drawn attention of this Court to information supplied under Right to Information Act, which is on record as Annexure-2 to the rejoinder affidavit. Based on said document, learned Counsel submits that four vacancies of Collection Peon are still available in District Haridwar, therefore the reason assigned for disallowing petitioners’ claim is unsustainable.
(4) Learned State Counsel, however, submits that there are only 56 post of Collection Amin sanctioned in District Haridwar, whereas there are as many as 59 employees who are serving. Thus he submits that the stand taken by the petitioners, based on Annexure-2 to the
2026:UHC:752 rejoinder affidavit, is not correct.
(5) Be that as it may, since petitioners contend that there are certain posts/vacancies still available in District Haridwar, against which petitioners can be accommodated, therefore, writ petition is
disposed of with a direction to the competent authority to re-examine petitioners’ claim for reengagement, subject to availability of post/vacancy. This Court hopes and expects that necessary
order shall be passed by the competent authority within three months from the date of production of certified copy of this order.
