ORDER This Criminal Original Petition has been filed challenging the docket
order dated 17.06.2026 passed in unnumbered Crl.M.P. No. of 2026 in S.C.No.321 of 2023.
2. The case was tried before the learned Special Court for Bomb Blast Cases, Coimbatore. A total of three accused were tried for the offences under Sections 294(b), 323, 326, 364, 307 and 506(ii) of IPC. By judgement dated 16.04.2025, all the accused were acquitted.
3. In paragraph No.23 of the said judgment, while dealing with the properties produced during the course of trial, the trial Court specifically found that, insofar as the car bearing Registration No. KL 60 A 0700 is concerned, interim custody had been entrusted to the police. The Trial Court further observed that, in the absence of any claim for ownership or return of the vehicle, the same shall stand confiscated after the expiry of the appeal period.
4. The petitioner now claims ownership over the said vehicle. Such claim has to be considered by the trial Court in the manner known to law. Therefore, the petition filed by the petitioner cannot be rejected at the threshold without being entertained. https://www.mhc.tn.gov.in/judis

5. In view of the above, this Criminal Original Petition is disposed of on the following terms:
(i) The petitioner shall re-present the application before the trial Court within a period of two weeks from the date of receipt of a web copy of this
order. (ii) On such re-presentation, the trial Court shall entertain the application and consider the same on its own merits and in accordance with law.
