Case No. 155 of 2023 for the offence registered under Sections 414, 468 and 34 of the Indian Penal Code, now said to have been pending in the court of learned Additional Chief Judicial Magistrate, Bermo at Tenughat. 2. Learned counsel for the petitioner submits that as per FIR itself, the name of the petitioner has transpired in the confessional statement of the co- accused, namely, Raju Nayak and upon this statement, another stolen motorcycle has been recovered from the house of the petitioner. The learned counsel submits that the petitioner is in custody since 11.12.2025. 3. During the course of hearing, the learned counsel for the petitioner has submitted that the petitioner has three criminal antecedents and he is on bail in those three cases. 4. Learned counsel for the State has opposed the prayer and has submitted that the stolen motorcycle has been recovered from the house of the petitioner. 5. After hearing the learned counsel for the parties and considering the facts and circumstances and that one stolen motorcycle is alleged to have been recovered from the house of the petitioner and that the petitioner also 2026:JHHC:6255 2 has criminal antecedents, four in number including the present one of similar nature, this Court is not inclined to enlarge the petitioner on bail.
