For Petitioner(s): Mr.K.Prasath For Respondent(s): Mrs.R.S.Indira Government Advocate (Crl.Side) ORDER The petitioner apprehends arrest for the alleged offence under Sections 329(2), 296(b), 118(1) & 351(3) of BNS, 2023, in Crime No.153 of 2026 on the file of the respondent police seeks anticipatory bail. 2. The case of the prosecution is that on the day of occurrence, the petitioner had threshed the corn crops in the defacto complainant’s agricultural land. https://www.mhc.tn.gov.in/judis CRL OP No. 18628 of 2026 __________ Page2 of 4 When this was questioned by the defacto complainant, the petitioner abused the defacto complainant and his family members and attacked them by a wooden log, cased injuries. Hence the case. 3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the defacto complainant. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner. 4. The learned Government Advocate (Criminal Side) submitted that the date of occurrence is 12.06.2026. It is further submitted that three persons sustained injuries in the occurrence. One Tamilselvi, who suffered grievous injuries, was admitted to the hospital on 12.06.2026 and was discharged only on 23.06.2026. The other injured persons, namely Soundhar and Venkatesh, were discharged from the hospital on 15.06.2026. 5.From the submissions made by the learned Government Advocate (Criminal Side), it is seen that the petitioner is alleged to have brutally assaulted three persons, including two women and one man. One of the injured, Tamilselvi, remained hospitalised for more than 11 days, while the other two injured persons underwent inpatient treatment for about three days. https://www.mhc.tn.gov.in/judis CRL OP No. 18628 of 2026 __________ Page3 of 4 6. Having regard to the nature of the allegations, the gravity of the injuries sustained by the victims, and the severity of the offence, this Court is of the considered view that enlarging the petitioner on anticipatory bail would not be justified and would shock the conscience of the Court. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
