1. Mr. Mohd. Safdar, learned counsel for the petitioner.
2. Mr. Tumul Nainwal, learned A.G.A. with Mrs. Sweta Badola Dobhal, learned Brief Holder for the State.
3. By the instant petition the petitioner is praying for the following relief:
“i. Issue a writ, order or direction in the nature of
certiorari quashing the impugned FIR lodged by the
respondent no. 3 on 18.02.2026 registered as FIR No.
87 of 2026 for the offences punishable under Section 3
Section 5 read with Section 11 of the Uttarakhand
Protection of Cow Progeny Act, 2007, Police Station
Bhagwanpur, District Haridwar (contained as
Annexure No. 1 to the writ petition. ii. Issue a writ, order or direction in the nature of
mandamus commanding and directing the
respondent no. 1 and 2 not to arrest the petitioner and
not take any coercive measure against the petitioner
in pursuance to the impugned FIR dated 18.02.2026
registered as FIR No. 87 of 2026 for the offences
punishable under section 3 section 5 read with
section 11 of the Uttarakhand Protection of Cow
Progeny Act, 2007, Police Station Bhagwanpur,
District Haridwar (contained as Annexure No. 1 to
the writ petition).”
4. After arguing at length learned counsel for the petitioner submits that the petitioner shall surrender before the court concerned on or before 27.03.2026 but taking into consideration that Ramzan are going on till then he may be protected.
5. In such view of the matter, the writ petition is dismissed as withdrawn with the direction to the petitioner to surrender before the court concerned on or before
27.03.2026.
6. Till then no coercive action shall be taken against the petitioner.
