For Petitioner(s): Mr.N.Arun Kumar For Respondent(s): Mr.R.Rajasekaran Counsel for Government of Tamil Nadu (Crl.Side) ORDER The prayer in the criminal original petition is to set aside the order made in Crl.MP.No.4817 of 2026 on the file of the learned Judicial Magistrate Court No.II, Coimbatore, dated 18.06.2026. https://www.mhc.tn.gov.in/judis CRL OP No. 19160 of 2026 __________ Page2 of 5 2.The petitioner is facing the case in crime No.115 of 2026 registered for the alleged offences under Sections 296 (b), 118 (1) and 351(3) of BNSS. 3.The allegation is that the accused way laid the defacto complainant and threatened why he behaved with in a particular manner with Prakash and even while the defacto complainant was trying to explain hit him on the head with the beer bottle, which he was keeping with him. 4.Considering the nature of the case, the petitioner was granted anticipatory bail vide order dated 08.04.2026 in Crl.MP.No.1199 of 2026 on condition that he should report before the respondent police daily at 10:00 am for a period of 15 days. It is also brought to the notice of this Court that the petitioner has several previous cases pending against him, in all totalling to 15 cases. Under the said circumstances, considering the overall facts and circumstances of the case, now the learned Judicial Magistrate cancelled the bail on the ground that the petitioner did not comply with the condition imposed while granting of anticipatory bail. 5.The contention made by the learned counsel for the petitioner is that merely because the petitioner is contesting the NDPS cases tooth and nail by bringing forth contra defence evidence, enraged by the same, the respondent police is not permitting him to sign before them everyday, even though the petitioner went to the police station. https://www.mhc.tn.gov.in/judis CRL OP No. 19160 of 2026 __________ Page3 of 5 6.I have considered the contentions made on behalf the petitioner. If the petitioner was prevented, immediately he ought to have filed a memo before the court concerned or sent a mail to the higher official. In the absence of the same, the mere ipse dixit before this court cannot be believed and therefore, it is certain that the petitioner did not obey the order of the Court granting anticipatory bail. However, considering the plea made by the learned counsel for the petitioner that the petitioner will regularly appear hereafter, if once an opportunity is granted, I am of the view, considering the facts and circumstances of the case, an opportunity can be given rather than cancelling the bail. 7.In view thereof, the impugned order dated 18.06.2026 shall stand set aside and the petitioner shall duly comply with the condition and the petitioner is imposed with the modified condition for his anticipatory bail that he should appear before the respondent police at 10:00 am on everyday for a period of 30 days starting from tomorrow. The petitioner need not await the copy of the order and shall start reporting before the respondent police from tomorrow.
