JUSTICE S SUNIL DUTT YADAV ORAL ORDER The present petition has been filed seeking for setting aside of the notice dated 01.09.2025 issued under Section 29 and 30 of the Karnataka Industrial Areas Development Act, 1966 at Annexure-R and for setting aside of the Final Notice dated 05.11.2025 at Annexure-S and certain other allied reliefs are sought. - 3 - HC-KAR NC: 2026:KHC:822 WP No. 35410 of 2025 2. The petitioner submits that pursuant to the notice issued, proceedings by the Special Land Acquisition Officer has been initiated and copy of the order sheet is produced at Annexure-T. 3. It is the further submission that petitioner was not given sufficient opportunity when the matter was posted for orders on 12.11.2025. It is submitted that statement of objections have been filed before the same authority on 18.11.2025 after the matter was posted for orders. Limited prayer made is that statement of objections filed, copy of which is produced at Annexure-V may be taken on record and petitioner may be heard and then the matter could again be reserved for orders. 4. Learned counsel for respondent authority submits that the order is not passed as on date. Though other parties have not been arrayed as parties, in light of limited prayer sought and as no prejudice as such would be - 4 - HC-KAR NC: 2026:KHC:822 WP No. 35410 of 2025 caused to the other parties, the petition is disposed of in the following terms: i) The statement of objections filed on 18.11.2025 copy of which is produced at Annexure-V stated to have been filed before the authority is to be taken on record. ii) Petitioner is to be afforded an opportunity of hearing for which petitioner is to be present before the Authority on 27.01.2026 and advance arguments. iii) Needless to state, the petitioner shall intimate the other parties regarding advancement of date on 27.01.2026. (iv) The petitioner is to cooperate in expeditious disposal of the proceedings and must not take any unnecessary adjournments. 5. In light of the directions passed, the order of the Special Land Acquisition Officer posting the case for orders is set aside while observing that the authority may reserve - 5 - HC-KAR NC: 2026:KHC:822 WP No. 35410 of 2025 the matter for orders after hearing the petitioner and other parties if they request for opportunity of hearing.
