No.15 of 2026 on the file of the respondent police, seeks bail. 2. The case of the prosecution is that on 03.03.2026 at about 10.30 p.m., near Irungal village, the accused waylaid the defacto complainant, abducted him and threatened him at knife point and snatched gold jewels and Rs.10,000/- from him at knife point. They further threatened the mother of the defacto complainant to bring her jewels and they obtained her jewels through a cousin of the defacto complainant and hence the case. 3. The learned counsel for the petitioner would submit that the petitioner is an innocent and he is under incarceration since 10.03.2026, that the defacto complainant is the cousin of the petitioner and there was money dispute and in furtherance of which, the petitioner went to the residence of the defacto complainant and the present case has been registered against him and the alleged robbed gold jewels and money have been recovered and hence prayed to enlarge the petitioner on bail. 4. The said contention of the learned counsel for the petitioner is totally objected by the learned counsel for the intervenor and he would submit that some of the accused are yet to be arrested and some properties are yet to be recovered. https://www.mhc.tn.gov.in/judis CRL OP No. 7923 of 2026 __________ Page3 of 5 5. The very same contention has been reiterated by the learned Government Advocate (Criminal side) appearing for the respondent police and he strongly opposed the bail application on the ground that some of the accused are yet to be secured. 5. I have given anxious consideration to the submissions made by the learned counsel on either side. 6. Taking into consideration of the fact that there are 10 accused involved in this case and only four accused have been remanded so far and upon the submission of the learned counsel appearing for the intervenor that some of the properties are yet to be recovered, it is not appropriate time to consider the bail application and therefore, this Court is not inclined to enlarge the petitioner on bail. 7.
