The petitioner- above-named is in custody since 20.08.2024 in connection with Bariatu (Ranchi) P.S. Case No. 141 of 2022 [G.R. Case No.2089 of 2024] for the offence registered under Sections 420, 467, 471/34 of the IPC. The prosecution case, in brief, is that the Government land under the occupation of Army was sought to be grabbed by creating forged and fabricated ownership documents like Adhar Card, Electricity Bill, Holding number etc. A racket of land grabbers by submitting forged documents obtained holding number in the name of Pradeep Bagchi for property at Morabadi Mouza, Ward No.21/19, Ranchi having an area of the plot measuring about 4.55 acres. The above property belonged to Late B. M. Laxman Rao and was given to Army and the same was under its occupation. It is submitted by the learned counsel on behalf of petitioner that a criminal case was also lodged by Enforcement Directorate (ED) for the offences under the P.M.L.A. Act in which he has already been granted bail by the Hon’ble Supreme Court. Although the petitioner is in custody for more than 1 year 5 months, but only one witness has been examined so far. Learned A.P.P. for the State has opposed the prayer for bail. It is submitted that petitioner is king-pin of the conspiracy and had received Rs.15 Lakhs as crime proceed in his account. Further, the prayer for bail of other similarly co-accused persons has been rejected by the Co-ordinate Bench of this Court. Considering the aforesaid facts and circumstances of the case and gravity of offence, the prayer for bail of the petitioner, is hereby, rejected. (Gautam Kumar Choudhary, J.)
