Side) for R1 https://www.mhc.tn.gov.in/judis CRL OP No. 16450 of 2026 __________ Page2 of 4 ORDER The prayer in the Criminal Original Petition is made to quash the final report in SC.No.162 of 2022 on the file of the learned Sessions Judge, Mahila Court at Chengalpattu. 2. The parties seeks quashing the proceedings on compromise. Both the victims, namely the de facto complaint / E.Mohanapriya and her sister, Jayanthi are present before the Court and the petitioner accused is also present before the Court. All of them stand to their position that the differences between them is ironed out and the victim, Jayanthi and the petitioner, Lokeshram are living together and they have also a child born to them. 3. In this case, it is stated that on account of the marital discord and the problem within the family, the allegation is made as if the petitioner tried to set the first victim, Jayanthi on fire and also tried to throw acid on the de facto complainant / her sister. It is seen that there is no injuries on both the victims and both the victims submit that the matrimonial discord has been resolved and the petitioner and Jayanthi are living together as on date. 4. Considering their wellbeing and considering the dictum laid down by the Honourable Supreme Court of India in BS Joshi and others Vs. the State of Haryana and Another, (AIR 2003 SC 1386), I am of the view that since the https://www.mhc.tn.gov.in/judis CRL OP No. 16450 of 2026 __________ Page3 of 4 allegations arise out of a matrimonial discord and subsequently the parties have ironed out the differences and are living together. In spite of the seriousness of the allegations, this is a fit case for excise of power as it is purely in between the couple and also the wellbeing of the couple and their tender child. 5. In view thereof, the Crl.O.P.No.16450 of 2026 is allowed and all the final report and all further proceedings in SC.No.162 of 2022 on the file of the Sessions Judge, Mahila Court, Chengalpattu stands quashed.
