The petitioner is aggrieved by the order of the Central Government Industrial Tribunal-cum-Labour Court, Chennai, dismissing EPF Appeal No. 142 of 2019 for default, owing to the non-appearance of the learned counsel for the appellant. 3. The learned counsel for the petitioner further submit that the said appeal was dismissed in exercise of powers under Rule 15(1) of the Employees' Provident Funds Appellate Tribunal (Procedure) Rules, 1997 and the appropriate remedy available to the petitioner for restoration of the appeal is under Rule 15(2) of the aforesaid Rules. 4. Therefore, the learned counsel for the petitioner seeks permission of this Court to withdraw this Writ Petition, with liberty to file an appropriate petition for restoration before the Tribunal under Rule 15(2) of the Employees' https://www.mhc.tn.gov.in/judis WP No. 27118 of 2026 __________ Page3 of 4 Provident Funds Appellate Tribunal (Procedure) Rules, 1997. He has also made an endorsement in the Court bundle to that effect. 5. In view of the submission and the endorsement made by the learned counsel for the petitioner, this Writ Petition is dismissed as withdrawn, with liberty to the petitioner to file an appropriate petition for restoration before the Tribunal under Rule 15(2) of the Employees' Provident Funds Appellate Tribunal (Procedure) Rules, 1997.
