This is an application for transfer of Matrimonial Divorce No. 53(T) of 2025 pending before the Court of the Additional Deputy Commissioner (Judicial) at Shillong, East Khasi Hills District to the Court of the Tura District Session Judge, West Garo Hills District, Meghalaya. 2. The abovementioned suit instituted by the respondent in the Shillong Courts, who is a Superintendent of Police, Fire Services it is submitted is at the initial stage and prayer has been made for transfer, in view of the difficulties being faced by the petitioner in attending the Court proceedings. 3. The ground as set out for transfer is that the petitioner is residing at Tura, in the district of West Garo Hills, and is aged about 58 years and is suffering from several chronic ailments including hypertension and is currently employed as a primary school Teacher. 4. Mr. R. Pahsyntiew, learned counsel on behalf of the petitioner submits that to attend the Courts in Shillong from Tura, involves long travel, which the petitioner considering her age and health condition is inconvenient and unsafe. He prays the prayer for transfer be considered and allowed. Page 3 of 4 5. Mr. P.T. Sangma, learned counsel on behalf of the respondent however has objected the same and has submitted that there is no difficulty for the petitioner to attend the Court in Shillong, and further that no medical certificates has been annexed to the writ petition to substantiate the claim that she is suffering from various chronic ailments. 6. This Court on hearing the learned counsel for the parties, firstly, notes the age of the petitioner, apart from the fact that she is a primary school Teacher, and a resident of Tura. The respondent, it is seen however, is the Superintendent of Police, Fire Services, and as such, in the considered view of this Court, there should be no impediment or difficulty in him attending the Courts at Tura, if the suit is transferred to West Garo Hills. 7. Accordingly, the Matrimonial Divorce No. 53(T) of 2025 shall stand withdrawn from the records of the Additional Deputy Commissioner (Judicial) at Shillong, East Khasi Hills District and be transferred to the Court of the Tura District Session Judge, Tura, for endorsement to the competent court to take up the matter. 8. As the parties are already present in Court, they be put to notice to appear from 1(one) month from today before the competent court. 9. Matter accordingly stands closed and disposed of.
