HC-KAR NC: 2026:KHC:4571 WP No. 35760 of 2025
THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT RESPONDENT NO.2 TO DISPOSE THE APPEAL IN R.A(KUN) NO.120/2024 AS PER THE GUIDELINES OF THE CIRCULAR ISSUED BY RESPONDENT NO.1 AS PER THE ANNEXURE-A AND ALLOW THIS WRIT PETITION WITH COST. THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER
Learned High Court Government Pleader takes notice for respondent Nos.1 and 2. Notice to respondent No.3 is not necessary for the following reasons. 2. The grievance of the petitioner is that respondent No.2-Assistant Commissioner, Tumakuru Sub-Division has not concluded the proceedings initiated by respondent No.3 under Section 136(2) of the Karnataka Land Revenue Act, 1964 although the appeal was filed on 04.03.2024. Learned counsel submits, while pointing out to the order sheet at Annexure-B that paper publication was taken out for respondent Nos.2, 3, 4 and 6 by order dated 20.02.2025 and thereafter the Assistant Commissioner has not heard the matter and has not concluded the proceedings. - 3 -
HC-KAR NC: 2026:KHC:4571 WP No. 35760 of 2025
3. On perusing the petition papers, this Court finds that on 20.02.2025 the learned counsel for the appellant had filed a memo for paper publication and thereafter the matter was never heard for arguments.
Nevertheless, since the appeal was filed on 04.03.2024, it would become incumbent upon the Assistant Commissioner to conclude the proceedings as expeditiously as possible and at any rate in terms of the Circular dated 18.02.2021 issued by the Government of Karnataka. Accordingly, the Writ Petition stands disposed of with a specific direction to respondent No.2-Assistant Commissioner, Tumakuru Sub-Division to conclude the proceedings in appeal bearing R.A.(KUN)No.120/2024 after hearing the rival parties, as expeditiously as possible and at any rate within a period of 3 months from the date of receipt of a copy of this order.
