Romesh Verma, Judge(oral) The present petition arises out of the order dated 27.02.2026, as passed by the learned Additional Principal Judge, Family Court, Nalagarh, District Solan, H.P., whereby the evidence of the present petitioner has been ordered to be closed.

Brief facts of the case are that the present respondent has instituted a petition under Section 13 of the Hindu Marriage Act, 1955 for passing of the decree of dissolution of marriage between the parties. The zimni orders appended with the present petition shows that notices were issued to the present petitioner on 22.08.2020. Thereafter on 13.12.2021, the petitioner appeared before the learned Additional 1 Whether reporters of Local Papers may be allowed to see the judgment? 2 District Judge, Nalagarh, District Solan, H.P. and thereafter the case was listed on different dates. On 11.05.2022, the learned Additional District Judge, Nalagarh, District Solan,HP framed the issues and thereafter the case was posted till 18.06.2025 when summons were issued for the examination of the witnesses of the present petitioner. On 09.10.2025, no RWs were present and thereafter the case was fixed on 24.11.2025, 17.12.2025, 16.01.2026, 26.02.2026 and finally on 27.02.2026, when the impugned order was passed. 3. It is contended by the learned counsel for the petitioner that the learned counsel appearing for the petitioner in the trial Court could not communicate the dates to the petitioner, as a result of which the evidence could not be recorded. He further submits that the present petitioner is suffering from skin disease and is undergoing treatment from PGI, Chandigarh and in that regard the medical record has been appended with the present petition as Annexure P-3. 4. Though, this Court finds no infirmity in the impugned order, however, in the interest of justice and as a matter of indulgence, one last and final opportunity is granted to the present petitioner to lead and conclude her evidence subject to the payment of cost of Rs.10,000/-. The cost shall be
3 paid to the present respondent within two weeks from today This Court has been informed that the case is fixed before the learned Additional Principal Judge, Family Court, Nalagarh, District Solan, H.P. tomorrow i.e on 28.04.2026. 5. The present petition is disposed off with a direction that one last opportunity shall be granted to the petitioner to lead and conclude her evidence. Since the case is fixed before the learned Additional Principal Judge, Family Court, Nalagarh, District Solan, H.P.,on 28.04.2026, therefore, the learned Additional Principal Judge, Family Court, Nalagarh, District Solan is directed to give next date to the respondent so that she can lead her evidence in support of her defence

With the above observations, the present petition is
disposed off. Pending application(s), if any, also stands disposed off.
