The present revision arises out of the impugned judgment of conviction and order of sentence dated 12.12.2025, passed by the learned Second Additional Sessions Judge, Raipur, District - Raipur (C.G.) in Cr. Appeal No. 231/2024, whereby the learned appellate Court has dismissed the HEERA LAL SAHU Digitally signed by HEERA LAL SAHU Date: 2026.02.13 16:56:55 +0530 2 appeal, affirming the conviction and sentence of the applicant under Section 138 of N.I. Act dated 28.06.2024 passed by the learned JMFC, Raipur, District - Raipur in Complaint Case No. 2029/2017 wherein the applicant has been sentenced to undergo S.I. for 3 months and to pay a fine/compensation of Rs. 10,00,000/- in default of payment of fine amount, additional S.I. for 2 months. 2. Heard on I.A. No. 03/2026, application under Section 147 of the N.I. Act of 1881, seeking permission of this Court to compound the offence on the basis of the compromise arrived between the parties. 3. The parties have jointly filed an application under Section 147 of the N.I. Act, 1881, which is supported by their affidavits. The parties have amicably settled their dispute and the applicant paid Rs. 3,00,000/- by DD No. 129557 dated 23.01.2026 to the respondent/complainant. 4. Learned counsel for the applicant prayed that the application may be allowed and the applicant may be acquitted for the aforesaid offence as the parties have arrived a amicable settlement. 5. Learned counsel for the respondent admitted to receiving the said amount in the matter and submits that there are no dues upon the applicant, and he does not want any 3 further prosecution against the applicant. 6. Heard learned counsel for both the parties and perused the material available on record including the impugned judgment. 7. Considering that offence under Section 138 of N.I. Act is a compoundable offence under the provisions of Section 147 of N.I. Act. Further looking to the facts and circumstances of the case, and also considering the statements made by the counsel for the parties before this Court, the compromise application is hereby allowed. Applicant Hariom Sharma is acquitted of the charge under Section 138 of N.I. Act. 8. Accordingly, the criminal revision is disposed of. The bail bonds and sureties of the applicant shall stand discharged. 9. Record of the trial Court along with the copy of this order be sent forthwith for compliance and necessary action, if any.
