CMP No.171 of 2026 By way of this application, the applicants have prayed for clarification of the order passed by this Court while finally disposing of the case on 11.12.2025.
Learned Counsel for the applicants apprises the Court that while disposing of the main petition and issuing a direction to the Authorities to decide the proceedings on or before 15.01.2026, the Court had ordered status-quo. But natural, he submits the status-quo was to be construed in terms of the prayer made in the writ petition. Yet, he submits that the Society concerned is not implementing the
order which has been passed in the arbitration petition, copy whereof is appended with the application, i.e. order dated 18.12.2025, passed by Additional Registrar (Monitoring) Cooperative Societies, Himachal Pradesh, in the garb of the
order passed by this Court by taking the plea that this Court has ordered status-quo. Having heard learned Counsel for the parties, this application is disposed of with the direction that the order passed by this Court while disposing of the main petition and ordering status-quo, should not be construed outside the ambit of the issues raised in the writ petition. Order passed by the Authority on 18.12.2025 is independent of that. Concerned Society has to implement the same, subject to its legal rights. Ajay Mohan Goel) Judge January 05, 2026 (Rishi)
