ORAL JUDGMENT (PER: HON'BLE MR. JUSTICE D K SINGH)

HC-KAR NC: 2026:KHC:16209-DB WA No. 1422 of 2025
3. The petitioners claim to be the owners of the land in question on the basis of sale deed. However, the petitioners have alienated the said land in favour of the respondent No.7 on 20.02.2024. The dispute before the writ Court was in respect of the order passed by the Deputy Commissioner for effecting the revenue entries in favour of respondent Nos.5 and 6. 4. We fail to understand that how the petitioners, who had already alienated the land in question in favour of respondent No.7 would have locus to maintain the writ petition. 5. The learned Single Judge having taken note of the fact that the petitioners have already alienated the property in question in favour of respondent No.7 and respondent No. 7 is not come before this Court, challenging the mutation of the name of the respondent Nos.5 and 6 in respect of the land in question, the writ petition has been dismissed. - 5 -

6. In view thereof, we see no reason to interfere with the impugned judgment and order dated 21.07.2025 passed by the learned Single Judge, which is why we dismiss this writ appeal. 7. However, we clarify that the revenue entries would be effected in pursuance of the order passed by Deputy Commissioner, which shall be subject to the final outcome of the pending suit between the parties. 8. In view dismissal of the appeal, pending interlocutory applications, if any do not survive for consideration, hence stand disposed of. Sd/- (D K SINGH) JUDGE
