JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner-accused is before this Court, seeking the following prayer: "WHEREFORE, the Petitioner above named humbly prays that this Hon'ble Court may be pleased to quash the proceedings in C.C.3898/2021 filed by the 1st respondent police in Crime No.82/2021 registered at Kodigenahalli police station for the offence punishable under Section 506, 448, 324, 354, 354(B) of I.P.C on the file of the Prl. Senior Civil Judge and JMFC at Madhugiri in Criminal Case No 3898/2021, in the interest of justice and equity." 2. Heard Sri. Deepak J., learned counsel appearing for the petitioner, Sri. B.N. Jagadeesha, learned Addl.SPP appearing for respondent No.1, Sri. Vivek N., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the subsistence of the petition, the parties to the lis have entered into a settlement and filed an application along with an affidavit seeking compounding of the offence. The affidavit reads as follows: - 4 - HC-KAR NC: 2026:KHC:1553 CRL.P No. 15725 of 2025 "AFFIDAVIT We (1) Pavan Kumar. K.C, S/o Chikkahanumanthappa, Aged about 30 Years R/at Kalenahalli Village, Kodigenhalli Village Madhugiri Taluk Tumkur District Karnataka- 563101 (2) Thriveni W/o Shivaraju Aged about 29 Years R/at Kalenahalli Village, Kodigenahalli Hobli, Madhugiri Taluk Tumkuru, Karnataka today at Bangalore. Do hereby solemnly affirm and state on oath as follows. We, submit that, we know the facts and circumstances of the case. Hence, we are swearing to this affidavit. (3) We submit that the Respondent No 2 had filed a Complaint before the the 1st respondent police in Crime No.82/2021 registered at Kodigenahalli police station for the offence punishable under Section 506, 448, 324, 354, 354(B) of I.P.C on the file of the Principal Senior Civil Judge and J.M.F.C at Madhugiri in Criminal Case No 3898/2021. (4) We submit that on the advise of the elders, family members and well wishers we have settled the matter amicably and hence the Respondent No 2 has agreed not to further prosecute the above matter. (5) We submit that as the Respondent No 2 does not want to prosecute the matter pending in Criminal Case No 3898/2021 on the file of the Principal Senior Civil Judge and J.M.F.C at Madhugiri. Under the aforesaid facts and circumstances of the case, we are before this Hon'ble Court with a prayer to compound the offences and quash the entire proceedings now pending. (6) Wherefore, we pray that, this Hon'ble Court be pleased to permit us to compromise the above case and allow the accompanying application and quash the proceedings now pending in Criminal Case No 3898/2021 on the file of the Principal Senior Civil Judge and J.M.F.C at Madhugiri for the offence punishable under Section 506,448,324,354,354(B) of I.P.C to meet the ends of justice. - 5 - HC-KAR NC: 2026:KHC:1553 CRL.P No. 15725 of 2025 We the Deponents do herby state that what is stated in the above mentioned paragraphs are true to the best of our knowledge, information and belief." 4. In the light of the offence being the one punishable under Section 354 and the matter being settled between the parties, I deem it appropriate to accept the settlement and close proceedings against the petitioner. 5. For the aforesaid reasons, the following: ORDER (i) Criminal Petition is disposed. (ii) Proceedings in C.C.No.3898/2021 pending before the Principal Senior Civil Judge and JMFC, Madhugiri, qua the petitioner stand quashed.
