JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners are before this Court seeking the following prayers: "Wherefore, the petitioners most respectfully pray that this Hon'ble Court may kindly be pleased to call for records and thereby pleased to quash the entire proceedings in Spl.C.No.98/2024 pending on the file of the learned Additional District and Sessions Judge, Fast Track Sessions Court-I at Chamarajanagar, for the offences punishable under Section 376(2)(n)(f), 341, 417, 323, 504, 506 read with Section 34 of the Indian Penal Code, 1860 and sections 4 and 6 of the Protection of Children from Sexual Offences Act 2012, by allowing this petition, in the interest of justice." 2. Heard Sri.Parameshwarappa C, learned counsel appearing for the petitioners, Sri.B.N.Jagadeesha, learned Addl. SPP appearing for the respondent-State and have perused the material on record. 3. Petitioners are accused Nos.1, 2 and 3 in a proceeding concerning offences punishable under Sections 4 and 6 of the Protection of Women from Sexual Offences Act, 2012. The 1st petitioner and the victim are married but are - 4 - HC-KAR NC: 2026:KHC:6539 CRL.P No. 15877 of 2025 facing trial. The charges are already framed and the trial is on. Learned counsel seeks quashment of the proceedings on the aforesaid score. 4. In the light of the said circumstance of the charges being framed and the trial being in progress, I deem it appropriate to dispose the petition reserving liberty to the petitioners to urge all the contentions before the concerned Court. 5. It is needless to observe the concerned Court would consider all those submissions and answer them while concluding the proceedings. The proceedings shall stand concluded within an outer limit of six months, if not earlier. Ordered accordingly and Criminal Petition is disposed. I.A.No.1/2025 stands disposed as a consequence.
