This petition is filed by accused No. 1 under Section 439 of Cr.P.C. praying to grant bail in S.C. No. 87/2025 (crime No. 66/2011 of Bagepalli Police Station, Chikkaballapura) registered for offence under Sections 366, 506 read with Section 34 of IPC pending on the file of III Additional District and Sessions Judge, Chikkaballapura. 2. Heard learned counsel for petitioner and learned HCGP for respondent – State. 3. Learned counsel for petitioner would contend that petitioner was not aware of the case registered against him. Petitioner had not received any summons or notice from the jurisdictional Court. Petitioner was arrested by executing NBW issued against him. Accused Nos. 2 and 3 have been acquitted by judgment dated 04.06.2015 passed in S.C. No. 168/ 2013. - 3 - HC-KAR NC: 2026:KHC:1527 CRL.P No. 15820 of 2025 Petitioner has now deposited Rs.25,000/- on 08.01.2026 in S.C. No. 87/2025 before the trial Court towards expenses incurred by the State in securing his presence. With this he prayed to allow the petition. 4. A case was registered against the petitioner in Crime No. 66/2011 in Bagepalli Police Station for offence under Sections 366-A, 506 read with Section 34 IPC. In the said crime charge sheet has been filed and case has been registered in C.C. No. 413/2013. In the said case evidence has been recorded under Section 299 of Cr.P.C. and case has been transferred to LPR. Thereafter, petitioner has been secured and case has been registered in C.C. No. 1380/2025. Said case has been committed to Sessions Court and now pending in SC No. 87/2025. Petitioner did not appear before the jurisdictional Court as he had not received any summons or notice. Petitioner is now ready to appear before the trial Court and cooperate for the speedy disposal of the case. Petitioner has now deposited Rs.25,000/- towards expenses incurred by the State in securing his presence. Said amount - 4 - HC-KAR NC: 2026:KHC:1527 CRL.P No. 15820 of 2025 deposited by the petitioner before the trial Court on 08.01.2026 in S.C. No. 87/2025 requires to be appropriated to the State. 5. Considering the above aspects, petitioner has made out case for grant of bail with conditions. 6. In the result, following; O R D E R Petition is allowed. Petitioner is granted bail in S.C. No. 87/2025 (Crime No. 66/2011 of Bagepalli Police Station, Chikkaballapura) pending on the file of III Additional District and Sessions Judge, Chikkaballapura subject to following conditions: I. Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the trial Court. II. Petitioner shall attend the trial Court on all dates hearing unless exempted and cooperate for speedy disposal of the case.
